Welcome to Eldie Creative.

These Terms & Conditions apply to your use of the Eldie Creative website and to purchases made from Eldie Creative.

Eldie Creative is operated by Catherine Bellini, a sole trader based in Queensland, Australia.

By accessing this website or placing an order with Eldie Creative, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other rights that cannot lawfully be excluded.

1. About Eldie Creative

Eldie Creative is an independent artist-led home décor and surface design studio.

Products available may include wallpaper, wallpaper samples, cushions, cotton throws and blankets, art prints, table runners and other Small Editions or home décor pieces.

All Eldie Creative products are made to order. Products are not held as ready-made stock unless expressly stated otherwise on the relevant product page.

Product availability may change from time to time.

2. Original Artwork & Product Character

Eldie Creative designs begin with original hand-drawn or hand-painted artwork.

Small irregularities, variations in line, brushwork, texture and other characteristics are an intentional part of the artwork and should not be considered defects.

Products are manufactured and printed using different processes and materials. Minor variations may therefore occur between products, print runs and materials.

3. Product Images, Mock-ups & Colour

Eldie Creative takes reasonable care to represent products accurately. However, many lifestyle images on the website are digital room mock-ups intended to help you visualise a design within a space.

Colours displayed on a computer, tablet or phone may vary depending on your device and screen settings and may not precisely represent the physical product.

Printing processes, materials and individual print runs can also result in reasonable variations in colour and appearance.

Where possible, please refer to physical samples before making significant colour or design decisions.

 

4. Wallpaper Samples

A wallpaper sample must be purchased before placing a full wallpaper order.

Wallpaper is digitally printed and made specifically for each order. Sampling allows you to view the physical design, colour, scale and material in your own space before committing to a larger made-to-order purchase.

Please view your sample in the room where the wallpaper will be installed and under the relevant natural and artificial lighting conditions.

Digital screens and room mock-ups can display colours differently from the physical product. Due to the nature of digital printing, reasonable variations may also occur between a wallpaper sample and a subsequent print run.

Purchasing a sample does not limit any rights you may have under the Australian Consumer Law.

 

5. Wallpaper Measurements & Ordering

Customers are responsible for measuring their space and calculating the amount of wallpaper required before placing an order.

Please measure carefully and, where appropriate, seek advice from your wallpaper installer or decorator before ordering.

Eldie Creative cannot offer a return, exchange or refund because of incorrect measurements, insufficient quantities ordered or other customer ordering errors, except where required by law.

Because wallpaper is printed to order, additional wallpaper ordered later may come from a different print run. Minor variations between print runs may occur. For this reason, we recommend ordering the full quantity required for your project at the same time.

 

6. Made-to-Order Products

All Eldie Creative products are currently made to order.

Production may begin shortly after an order is placed. If you need to change or cancel an order, please contact cat@eldiecreative.com as soon as possible.

An order may only be changed or cancelled if production has not yet commenced.

Once an order has entered production, it cannot normally be changed or cancelled for change-of-mind reasons.

This does not affect your rights where a product is faulty, damaged, incorrectly supplied or otherwise fails to meet a consumer guarantee that applies under law.

7. Prices & Payment

Prices are displayed in the currency selected or indicated on the website.

Payment must be received in full before an order enters production.

Available payment methods may include major credit or debit cards, PayPal, Apple Pay and Google Pay. Available payment options may vary depending on your location and the payment services supported by the website.

Eldie Creative reserves the right to correct genuine pricing, product or website errors. If an error affects an order you have already placed, we will contact you before proceeding where reasonably practicable.

 

8. Production & Dispatch

Because products are made to order, production times vary depending on the product.

As a general guide:

• wallpaper production may take approximately 3–7 working days before dispatch; and

• home décor products may dispatch within approximately 2–3 working days.

Any production or dispatch timeframe displayed on the website is an estimate rather than a guaranteed delivery date unless expressly stated otherwise.

Orders are generally not processed on weekends or major public holidays.

 

9. Shipping & Delivery

Eldie Creative currently supplies products to a range of destinations, including Australia, New Zealand, the United Kingdom, United States and Canada, with selected home décor products also available to European destinations.

Availability and shipping destinations can vary by product.

Fabric and products for destinations not available through the online checkout may be available by contacting cat@eldiecreative.com directly.

After dispatch, estimated delivery is generally:

• United Kingdom: approximately 1–3 working days; and

• Australia, United States and New Zealand: approximately 3–6 working days.

Other destinations and products may take approximately 3–10 working days or longer depending on the destination, delivery service and customs processing.

These delivery periods are estimates only.

Once an order has been dispatched, delays caused by postal services, couriers, customs, weather, industrial action or other circumstances outside Eldie Creative's reasonable control may affect delivery.

Where a delivery is delayed or appears to be lost, please contact Eldie Creative and we will reasonably assist you in investigating the delivery with the relevant carrier.

 

10. Delivery Addresses

Customers are responsible for providing a complete and accurate delivery address when placing an order.

Please contact Eldie Creative immediately if you discover an error in your delivery details.

If an order has not yet been dispatched, we will make reasonable efforts to update the address. Once an order has been dispatched, we may not be able to redirect it.

Eldie Creative is not responsible for additional delivery or replacement costs resulting solely from an incorrect or incomplete address supplied by the customer, except to the extent required by law.

 

11. Customs, Duties & Taxes

International orders may be subject to import duties, taxes, customs charges or other fees imposed by the destination country.

Some duties or taxes may already be included within the product price or shipping arrangements depending on the product and production partner.

Where additional import duties, taxes or customs charges are imposed and have not been collected by Eldie Creative at checkout, these are the responsibility of the customer.

Customs requirements and charges are determined by the relevant authorities and are outside Eldie Creative's control.

 

12. Change of Mind Returns

Because every Eldie Creative product is made specifically to order, we do not offer returns, exchanges or refunds for change of mind.

This includes returns resulting from incorrect measurements, incorrect quantities ordered or a customer changing their mind about a colour or design after ordering.

This policy does not exclude or limit your rights under the Australian Consumer Law or other applicable laws.

 

13. Faulty, Damaged or Incorrect Products

Eldie Creative wants you to receive your order as it was intended.

If your product arrives damaged, faulty or incorrect, please contact cat@eldiecreative.com, preferably within 7 days of delivery, with your order details and photographs of the product and packaging where reasonably possible.

Photographs help us understand the problem and resolve manufacturing or delivery issues quickly.

The 7-day notification request does not limit any rights or remedies you may have under the Australian Consumer Law.

Where a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and applicable law.

 

14. Trade Customers

Eldie Creative offers selected trade services to interior designers and other approved design professionals and businesses.

Trade access is subject to approval by Eldie Creative. We reserve the right to approve or decline trade applications where reasonably appropriate.

Trade pricing, sample discounts, services and benefits may change from time to time.

Unless separate written terms have been agreed, these Terms & Conditions also apply to trade purchases to the extent applicable.

Additional terms may apply to bespoke projects, custom design work and commercial commissions.

 

15. Bespoke & Custom Design

Bespoke design services, including selected colour or scale customisation, are currently offered to approved trade customers.

The scope, price, timeframe, revisions, intellectual property rights and other conditions applying to bespoke projects may be set out separately in a written quotation or project agreement.

Bespoke and customised products cannot be returned or refunded for change of mind once approved and entered into production.

Nothing in this section limits rights or remedies that cannot legally be excluded.

 

16. Intellectual Property

Unless otherwise stated, the original artwork, illustrations, surface patterns, designs, graphics, branding, written content and other creative material displayed on the Eldie Creative website are owned by or licensed to Catherine Bellini/Eldie Creative and are protected by applicable intellectual property laws.

Purchasing an Eldie Creative product gives you ownership of the physical product purchased. It does not transfer ownership of the artwork or grant you reproduction, licensing or commercial rights to the design.

You must not, without prior written permission:

• reproduce or copy Eldie Creative artwork or surface patterns;

• manufacture products using an Eldie Creative design;

• scan, trace, digitally reproduce or recreate an Eldie Creative design;

• use Eldie Creative artwork for commercial purposes;

• sell or distribute digital copies of Eldie Creative artwork; or

• use Eldie Creative imagery or designs in a way that suggests an unauthorised commercial association with Eldie Creative.

Personal enjoyment of the physical product you have purchased is, of course, welcomed.

 

17. Website Images & Mock-ups

Photography, graphics, product imagery and room mock-ups displayed on the website may have been created by Eldie Creative or created using appropriately licensed design, photography, digital or image-generation resources.

These images are provided for product presentation and visualisation purposes.

Unless expressly permitted, website imagery may not be copied, reproduced or used commercially by another person or business.

 

18. Customer & Designer Photography

Eldie Creative loves seeing its designs in real homes and projects.

If you send us photographs of an Eldie Creative product in your home or project, we will seek or rely on your permission before using those photographs for Eldie Creative marketing, website or social media purposes.

Where appropriate, photographers, designers and other creative contributors will be credited as agreed.

Providing an image to Eldie Creative does not automatically transfer ownership of the photograph to Eldie Creative.

 

19. Promotions & Discount Codes

From time to time Eldie Creative may offer promotional codes, discounts or special offers.

Unless otherwise stated:

• promotions cannot be combined;

• promotional codes may have an expiry date;

• promotions may apply only to selected products, customers or regions; and

• individual promotions may be subject to additional conditions displayed at the time of the offer.

Eldie Creative may withdraw or correct a promotion where there has been a genuine error, misuse or technical problem, subject to applicable law.

 

20. Website Availability & Information

Eldie Creative takes reasonable care to keep product descriptions, pricing, availability and other website information accurate and current.

Occasionally, errors or technical issues may occur.

We may update product information, designs, prices, materials, availability or website content from time to time.

We do not guarantee that the website will always be uninterrupted, error-free or continuously available.

 

21. Third-Party Services

The Eldie Creative website may use or link to third-party services, including payment providers, delivery companies, production partners or external websites.

Those third parties may operate under their own terms and privacy policies.

Eldie Creative is not responsible for the independent operation or content of third-party websites or services, except to the extent that responsibility cannot legally be excluded.

 

22. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where doing so would be unlawful.

To the extent permitted by law, Eldie Creative is not liable for loss caused solely by circumstances outside its reasonable control or by a customer's failure to follow supplied product information, measurement requirements, installation guidance or care instructions.

Nothing in these Terms is intended to exclude liability where it cannot legally be excluded.

 

23. Privacy

Personal information provided through the Eldie Creative website is handled in accordance with the Eldie Creative Privacy Policy and applicable privacy laws.

Please refer to the separate Privacy Policy for information about how personal information is collected, used and handled.

 

24. Changes to These Terms

Eldie Creative may update these Terms & Conditions from time to time to reflect changes to products, services, business practices or applicable laws.

The version published on the website at the time you place an order will generally apply to that order.

The date of the most recent update will be displayed at the top of this page.

 

25. Governing Law

These Terms & Conditions are governed by the laws applicable in Queensland, Australia, subject to any mandatory rights you may have under applicable consumer laws.

Nothing in these Terms prevents a customer from exercising rights available to them under applicable law.
